Can I get one if I'm not afraid of the person and they haven't threatened me? If I just want them to stop stalking me and leave me the fuck alone. And then if I have one...can I shoot them if they try to contact me again?

(I'm serious)

I'll put you in contact with my ex-girlfriends, they'll give you all the information you need.

Seriously though, I think you can get a restraining order if the person is truly bothering you, regardless of the risk of physical harm. But I don't think a person being annoying is reason enough.

It should really be a last resort though, the whole thing seems like a complete hassle.

You can get a restraining order if you're being hurt physically, or mentally. Say you're being stalked, without any physical attacks upon you. You can place a restraining order to keep them afar from you. If they break that order, it's very possible they will get arrested. Now if you're attacked and gun down that sucka mc, you can get away with it, as it is self-defense.

also, do not shoot them unless they are attacking you or entering your home unlawfuly

but if they do attack me and I shoot them I'm going to be in jail trying to prove that I couldn't escape them....right?

depends on how johnny law looks at it. you may not sit in jail but you might also, really is going be up to the LEO's and DA on how the evidence looks.

but, hypothetically speaking, if you did find yourself in that sort of situation, the best thing to do would not speak a word to the LEO's except "i would like to contact me lawyer" and not give a statement until you have spoken to an attorney.

The thing is, in the hypothetical situation, you killed a person. First off, you're a woman and you're sensitive, your conscience would eat you for murdering a human being. Second, good luck getting a job with "murder in self-defense" on your record. Third, good luck finding a husband who's not scared of your psychotic ass.

Point is, stop being stupid and realize you're not going to kill anyone and you're overreacting.

Aside from all that, good luck escaping prison time. Self-defense is not that easy to prove.

You can't shoot them for attacking you unless you felt your life was in danger and you couldn't get away, like by running or driving away. That means they have to have some kind of weapon in their hand or they say they're going to kill you. Or they're choking or hitting you. It can't be, "I thought they were going to hit me." Or, "they grabbed me." That's not enough. Unless you use "green bullets" which are environment friendly and will earn you get-out-of-jail points.

eric the wigger, grow up already.

If you do get a restraining order, how does it work? if you caught the stalker in your area or neighborhood, you call the law enforcement or something and let them know he/she/eric is still stalking you? or how close or under what circumstances the stalker can not be close to you?

if you get a restraining order it might make things even worse because when the person thats stalking you knows you have a restraining order against them, there is no telling what they could do cuz the cops can't always be around to protect you..and the law only really comes into favor after someone tries to do something to another person (in that situation). my advice...take kick boxing lessons and learn to protect yourself.

I never said I was going to kill anyone.
