Question about sampling

Does the track get laid out with the sample(s) and then send to get the sample approved through the original artist/label/whoever

or

does a producer, artist or whoever of the track using the sample have to get the sample cleared before they can even start laying out a new track using that sample?

This is for major artists who use samples (ie: Kanye) who are going to put out an album with songs using those samples.

yea they sample and make the record first, then the og artists approve it or not. remember bout a year an half ago, nelly sampled the NBA theme song and made a record. But they denied the sample because he used too many bad words in there n the theme wasn't hearable to listeners of all ages.

Sometimes the original artist starts to get picky and may make the artist bleep out any swear words. E.g School Spirit and Through the Wire is also edited.
